Privacy Policy and Notice

This is the privacy notice of Kesby Investigations Group Pty Ltd.  In this document, “we” or “us” refers to Kesby Investigations Group Pty Ltd, registered in Australia with ABN 73 608 618 784.

This is a notice to tell you our policy about all information that we record about you. It covers both information that could and could not identify you and information.

We are extremely concerned to protect your privacy and confidentiality. We understand that all users of our web site are quite rightly concerned to know that their data will not be used for any purpose unintended by them, and will not accidentally fall into the hands of a third party. Our policy is both specific and strict. It complies with Australian law and with the laws of all jurisdictions of which we are aware. If you think our policy falls short of your expectations or that we are failing to abide by our policy, do please tell us.

We regret that if there are one or more points below with which you are not happy, your only recourse is to leave our website immediately.


Except as set out below, we do not share, or sell, or disclose to a third party, any personally identifiable information collected at this site.


Here is a list of the information we collect from you, either through our web site or because you give it to us in some other way, and why it is necessary to collect it:

  • Why is the interview being conducted by an external provider?
    To ensure the investigation is conducted independently. Kesby Investigations Group specialises in independent factual investigations. By outsourcing the collection of the facts to us, your Claims Advisor is ensuring detailed and neutral collection of statements.
  • Where will the interview take place?
    If you’re a Claimant and off work due to incapacitation, the interview can be conducted in your home so that you don’t need to travel. If you’re back at work on suitable duties – or even back to full duties – the interview can be conducted in the workplace during your working hours. However, if you’d prefer to do the interview outside of your working hours, that’s ok too, and can be done either at the workplace or your home. If you live outside of the Greater Brisbane area, the interview might be conducted via telephone; however, depending on the type of claim, it might be conducted in person. Witness interviews can be conducted either during or outside of work hours at your home, at the workplace and, sometimes, via telephone.
  • Who will perform the interview?
    Most interviews are conducted by Principal Investigator Jeremy Kesby. When Jeremy is unavailable, one of his Senior Investigators will conduct the interview.
  • How long will the interview take?
    The length of interviews varies greatly on a case-by-case basis. The interviewer will discuss this with you when scheduling the interview with you.
  • Can I refuse to participate in the interview?
    If you are a witness, participation is not compulsory. If you are the Claimant and do not wish to participate in an interview, please revert back to your Claims Advisor for further instructions.
  • What do I need to bring to the interview?
    Some people find it helpful to bring diaries, emails, medical certificates, etc, in order to ensure accuracy of dates and information.
  • Can I have someone with me during the interview?
    Yes. You may have a support person present for emotional support. The support person should not be a potential witness (someone with direct knowledge of/who has witnessed alleged incidents) as they might need to be independently interviewed later.
  • What is the difference between a support person and a representative?
    A support person is a trusted friend, family member of colleague that you elect to have with you at the interview for your own emotional support. A representative is someone such as a union delegate.
  • Are support persons and representatives required to maintain confidentiality?

  • What happens after the interview?
    Two to three days (on average) after your interview, the interviewer will email your draft statement to you for review. It will come to you as a Microsoft Word document with tracked changes activated. You will likely see yellow highlighting throughout the statement which represents things the interviewer asked you to follow up on (e.g., dates, surnames, etc, that you were unsure of during the interview), evidence that the interviewer asked you to provide in support of your statement (e.g., copies of emails, diary entries, photos, etc), and additional questions.
  • What if I am going on leave for an extended period shortly after the interview and won’t be able to review the draft statement?
    Please advise either your Claims Advisor or the interviewer asap.
  • Can I provide additional information after the interview?
    Yes. If you believe you have further information to provide, please add it to your draft statement when reviewing it.
  • How do I sign my statement?
    Kesby Investigation Group uses a secure online e-signature service for statement signing. You can sign your statement using your smartphone, tablet or computer.
  • Will I receive a copy of my statement?
    Yes. You will receive a PDF copy of your statement via email.
  • What happens to my statement once I have signed it?
    Once you have signed your statement, the interviewer will send a copy to your Claims Advisor.
  • Are witnesses interviewed in a particular order?
    Following the Claimant interview, witnesses are usually interviewed based on their availability.
  • How long will the investigation take to be completed?
    This varies greatly depending on the number of witnesses to be interviewed, witness availability for interview (e.g., annual leave, sick leave, etc) and how quickly the witnesses review and sign their statements.
  • Will I be provided with a copy of the Investigation Report?
    No. There is no Investigation Report as such because Kesby Investigations Group does not provide findings, advice or have any involvement in deciding the outcome of the claim.
  • Who am I allowed to talk to about the investigation?
    In order to maintain confidentiality – and prevent contamination of others’ recall – you should not discuss the investigation with others, with the exception of your nominated support person / representative. If you have questions for other people, or if you think a person may be able to provide relevant information, you should inform the interviewer.
  • Should I tell the interviewer if I become aware that others have knowledge of or witnessed something relevant to the investigation?
  • I am a witness. Will I be informed of the investigation outcome?
    No. The outcome is confidential in order to protect the privacy of all involved.
  • Who makes the decision on whether to accept the claim?
    The Claims Advisor managing the claim is the decision maker.
